International law is made by the consensus of sovereign states. Thus, if 43 Member States of the UN jointly publish a declaration that “there is no international right to abortion, nor any international obligation on the part of States to finance or facilitate abortion”, then it is so – irrespective of what UN bureaucrats, some ideologically misguided academics, the EU’s Fundamental Rights Agency, the European commission, George Soros, Melinda Gates, or whoever else may tell you.
From the EU, the signatories include Hungary and Poland.
The Geneva Consensus Declaration (GCD) is a very important initiative both politically and legally. The declaration calls on the UN system to respect sovereignty in women’s health and other social programs. It affirms the importance of the family as the “natural and fundamental group unit of society” and categorically denies that abortion is an international right. The declaration was deposited with the UN Secretary-General (UN Document A/75/626) and is available as an official document of the UN General Assembly.
As long as member states support it and give it visibility, the GCD legally blocks the development of any customary international right to abortion.
